1. Agreement to Terms
By accessing or using any software application or service provided by DMC Labs, LLC (“DMC Labs,” “we,” “us,” or “our”) you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
DMC Labs provides software applications including but not limited to personal-finance tools (Mizu), family dashboards (KiddoCash), and related services. Our applications are provided for personal, non-commercial use unless otherwise specified.
3. Eligibility and Access
Some applications are made available on an invite-only basis. We reserve the right to grant, refuse, or revoke access at our discretion. Use of our applications by an account that has not been granted access (or whose access has been revoked) is not permitted.
You must be at least 13 years old to create an account on a DMC Labs application. Some applications, such as Mizu, are restricted to users 18 and older because they integrate with United States bank accounts, which require account-holder ages of 18 or above. Child profiles within family applications are governed by the parental-consent flow described in our Privacy Policy.
4. User Accounts
Our services authenticate through third-party identity providers (such as Google or Apple). You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
5. User Responsibilities
You agree to:
- Provide accurate information when using our services.
- Use our services only for lawful purposes.
- Not attempt to interfere with, disrupt, or reverse-engineer our services.
- Not attempt to gain unauthorized access to our systems, other users’ data, or any administrative interfaces.
- Not use our services to impersonate any person or entity.
6. Parental Consent and Children’s Features
Certain applications include features designed for use by families, including dashboards accessible by children. By using these features, you represent that:
- You are the parent or legal guardian of any child whose profile you create.
- You consent to the collection and use of your child’s information as described in our Privacy Policy.
- You understand that you may revoke consent and request deletion of your child’s data at any time.
We comply with the Children’s Online Privacy Protection Act (COPPA). Before any child data is collected, we require verifiable parental consent through our email-based verification process. See our Privacy Policy for details.
7. Device Authorization
Where applicable, access to child or shared dashboards is controlled through device authorization. You are responsible for approving or denying device access requests. We recommend reviewing authorized devices periodically and revoking access for any devices you do not recognize.
8. Financial Data and AI Categorization
Certain applications connect to your financial accounts through regulated third-party aggregators (such as Teller) and assist you in labeling and categorizing your transactions, including with the help of large language models (such as Microsoft Azure OpenAI). You acknowledge that:
- The connection to your bank is read-only. We cannot move money, change account settings, or initiate transactions of any kind on your behalf.
- You are solely responsible for the accuracy of any financial information shown.
- DMC Labs is not a financial institution and does not provide financial, legal, tax, or investment advice. Categorizations, insights, and projections are presented for informational purposes only.
- AI-suggested category labels are best-effort. You should review and confirm them. We do not warrant their accuracy.
- When connecting bank accounts through a third-party aggregator, you are subject to that aggregator’s terms and privacy policy in addition to ours.
- Transaction descriptions are automatically scanned to redact sensitive identifiers (such as account numbers) before storage and before any AI processing. You should still review uploaded data for accuracy.
9. Data Portability and Deletion
You may export your data or delete your account at any time through the application’s Settings. Account deletion is permanent and removes all transactions, labels, push subscriptions, and bank connections within seconds. We retain a minimal deletion record (your email and the deletion timestamp) as a record that the deletion occurred, for fraud-prevention purposes; see our Privacy Policy for details.
10. Intellectual Property
All content, features, and functionality of our services are owned by DMC Labs, LLC and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our software without our prior written consent.
11. Voluntary Contributions
Where applications offer a “tip jar” or voluntary contribution feature, contributions are made voluntarily, are not refundable, and do not entitle you to any product, service, or feature beyond what is otherwise made generally available. Contributions are non-recurring unless explicitly described as recurring.
12. Limitation of Liability
To the fullest extent permitted by law, DMC Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim, or one hundred US dollars, whichever is greater.
13. Disclaimer of Warranties
Our services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause. Upon termination, your right to use our services will immediately cease. The provisions of these Terms that by their nature should survive termination shall do so.
15. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by updating the “Last updated” date and the version, and by requiring re-acceptance within our applications. Continued use of our services after changes constitutes acceptance of the revised terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. The exclusive venue for any dispute arising from these Terms or our services shall be the state or federal courts located in the State of Florida.
